Both the Aurora police and the FBI had already confirmed within the first 24 hours that James Holmes has had no previous run-ins with the law except for one speeding ticket. If he had been detained by police in an Occupy movement, that would have shown up in his record and they wouldn't have reported that he was a complete unknown.
Secondly, these are two entirely different people. The Occupy protester seen being detained/arrested was in New York City on the Brooklyn bridge. James Holmes lived in Denver before there was an OSD, making that impossible even if the photo had been taken in San Diego.
