This
article explains why... Here is the mountain the DA has to climb, he has
to prove that the officer was not in fear of his life and if he was,
would a reasonable officer use deadly force. This is a U.S. Supreme
Court ruling. IF Mr Brown did in fact attack the officer through the
window and then run away and then turn around and start to walk
toward the officer, then the officer would be justified in using deadly
force. Whether is was armed or not doesn't make any difference because,
he had already attacked and tried to take his weapon and a reasonable
officer would assume that he attended to attack again and possibly try
to take his gun a second time. You have to take in size difference
between the two individual also. I'm not saying this happened but, This
is just one reason you can justify shooting an unarmed person. Size
difference between them is going to be a big factor.
